General Terms and Conditions of Sale
Article 1 – Identification and General Provisions
1.1 “Sky Dôme” is an event organized by Kiwi évent BV, whose registered office is located at Steenweg op Mechelen 455/1, 1950 Kraainem, VAT number BE1013343855.
1.2 Booking a “Sky Dôme” dinner via the reservation service (www.sky-dome.be) implies the unreserved acceptance by the customer (hereinafter referred to as “the Client”) of all the provisions of these General Terms and Conditions (hereinafter referred to as “the Conditions”).
1.3 The dinner generally takes place from Thursday to Sunday at 7:30 PM. The arrival location is specified for each event. (Schedule modifications may be considered with the organizers’ agreement). Service is provided by a chef, a professional kitchen team, and an experienced wait staff. A gourmet menu will be served.
A manager is available throughout your dining experience to answer your questions and address your concerns.
1.4 The fact that Kiwi évent BV does not enforce any provision of these Conditions at a given time shall not be interpreted as a waiver of said provision.
Article 2 – Terms of a Sky Dôme Dinner
The Client does not have the right to withdraw from the purchase.
2.1 Booking a dinner implies that every order will result in either a written order from the Client or a confirmation of the order by Kiwi évent.
2.2 The reservation of a dinner is only valid for the date and time agreed upon with Kiwi évent and for the number of guests confirmed.
2.3 Unless otherwise specified by Kiwi évent BV, the start and end of the “Sky Dôme” dinner take place at the designated event site. The dinner lasts approximately 4 hours for a 5-course menu.
2.4 As this is a remote contract in accordance with Article VI.47 of the Law of December 21, 2013, which introduces Title VI “Market Practices and Consumer Protection” into the Economic Law Code, the Client does not have a right of withdrawal as provided in this article since the goods supplied under this contract are likely to deteriorate or expire quickly (Article VI.53, 4°).
2.5 Except in cases of force majeure, the dinner cannot be refunded, exchanged, or modified, except in case of cancellation by Kiwi évent BV. If Kiwi évent BV cancels the dinner on the agreed date and time, the Client may choose between rescheduling to another date/time or receiving a refund.
2.6 In case of cancellation due to force majeure (weather conditions, epidemics, pandemics, protests, terrorist threats, transportation or supply blockages, earthquakes, fires, storms, floods, IT system failures, telecommunication issues, etc.), the dinner may be rescheduled or refunded under the following conditions:
– Cancellation at least 15 business days before the event: exchange possible, 100% refund.
– Cancellation at least 5 business days before the event: exchange possible, 40% refund.
– Cancellation within 3 business days before the event or on the event day: no exchange, no refund possible.
2.7 Smoking is prohibited in the domes. Additionally, no external food or beverages are allowed at the event venue.
Article 3 – Liability
3.1 Kiwi évent BV expressly declines any liability for technical failures at the event site that may temporarily prevent the organization of a “Sky Dôme” dinner. Kiwi évent BV shall not be held responsible for delays, failures, or service interruptions due to force majeure or external events.
3.2 Kiwi évent BV shall not be held responsible for the behavior of guests during the “Sky Dôme” dinner.
3.3 Kiwi évent BV shall not be held responsible for any loss or damage (direct, indirect, material, or immaterial) suffered during the dinner. This also applies to theft or loss occurring before or during the event.
Article 4 – Pricing
4.1 The pricing for the Sky Dôme dining experience is:
Sky Dôme 5-course menu (Thursdays, Saturdays and Sundays):
– €140 incl. VAT per person (excluding beverages).
– Any promotional offers or discounts may apply separately.
4.2 The Client agrees to pay the full amount before the scheduled event date for the Sky Dôme experience.
Article 5 – Miscellaneous Provisions
5.1 The Client acknowledges and accepts that the General Terms and Conditions of Sale section is an integral part of the Conditions and is incorporated by reference. The General Terms and Conditions of Sale may be modified at any time by Kiwi évent.
5.2 The Conditions apply exclusively to the booking and use of the “Sky Dôme” dinner, to the exclusion of any other Kiwi évent BV products governed by separate general terms of use.
Article 6 – Nullity of a Clause, Applicable Law, and Jurisdiction
6.1 The nullity, invalidity, or unenforceability of any provision of these Conditions shall not affect the validity of the remaining clauses, which shall remain in effect. Any provision found to be null, void, or unenforceable shall be considered unwritten. Kiwi évent BV agrees to replace such provision with another one that fulfills the same function as closely as possible.
6.2 These Conditions are exclusively governed, interpreted, and applied in accordance with Belgian law. Only the courts of Brussels shall have jurisdiction over any disputes.
